1. Agreement to Terms

By accessing or using Alpha Factory (www.thealphafactory.io), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the platform. Alpha Factory is operated from the Netherlands (KVK: 87420309).

2. Service Description

Alpha Factory is a premium crypto investing education platform that provides:

• Educational articles, videos, and guides about cryptocurrency investing
• Portfolio analysis and risk management tools
• Dollar-cost averaging (DCA) simulators and calculators
• Market data visualizations and educational commentary
• Community access via Discord

All content and tools are provided for educational purposes. We do not provide personalized financial advice, manage investments, or execute trades on your behalf.

3. Educational Content Disclaimer

To be absolutely clear:

• No investment advice: No content on Alpha Factory should be interpreted as a recommendation to buy, sell, or hold any cryptocurrency or financial instrument.
• No guarantees: Past performance discussed in educational content does not guarantee future results. All examples are for illustration only.
• Your responsibility: You bear full responsibility for your investment decisions. Alpha Factory, its founder, and its team are not liable for any financial losses.

4. Account Terms

• You must sign in using Discord OAuth. We do not offer email/password registration.
• One account per person. Creating multiple accounts to abuse free trials or promotions is prohibited.
• You are responsible for maintaining the security of your Discord account. Alpha Factory is not liable for unauthorized access resulting from your Discord account being compromised.
• You must be at least 16 years old to create an account and use the platform.
• You agree to provide accurate information and to keep your account details up to date.

5. Payment Terms

• Premium subscriptions are available on monthly and yearly billing cycles.
• All payments are processed securely through Stripe. We do not store your credit card details.
• Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
• Prices are displayed in the currency shown at checkout and include applicable taxes.
• 30-day money-back guarantee: If you are not satisfied with your premium subscription, you can request a full refund within 30 days of your initial purchase. Refund requests after 30 days are handled on a case-by-case basis.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.

6. Intellectual Property

All content on Alpha Factory — including but not limited to articles, videos, guides, tools, graphics, logos, and software — is the property of Alpha Factory or its content creators and is protected by copyright and intellectual property laws.

• You may not reproduce, redistribute, sell, or publish our content without explicit written permission.
• You may share brief excerpts or screenshots for personal, non-commercial use with proper attribution.
• Screen recording, downloading, or ripping premium content (videos, tools) is strictly prohibited.
• Sharing your premium account credentials or providing access to gated content to non-subscribers is prohibited and may result in account termination.

7. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the platform, other accounts, or our systems
• Use automated tools (bots, scrapers) to access or extract content from the platform
• Impersonate Alpha Factory, its founder, or other users
• Distribute malware or engage in any activity that disrupts the platform
• Use our educational content to market or sell your own financial advisory services without permission
• Harass, abuse, or threaten other community members on the platform or in our Discord server

8. Limitation of Liability

To the maximum extent permitted by Dutch law:

• Alpha Factory provides its services "as is" and "as available" without warranties of any kind, express or implied.
• We do not guarantee that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.
• We are not liable for any financial losses, investment losses, or damages arising from your use of our educational content or tools.
• Our total liability for any claim related to the service shall not exceed the amount you paid to Alpha Factory in the 12 months preceding the claim.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.

9. Termination

• You may cancel your subscription at any time through the platform or by contacting us. Your access continues until the end of the current billing period.
• We reserve the right to suspend or terminate your account if you violate these Terms of Service, with or without notice.
• Upon termination for a violation, you are not entitled to a refund for the remaining subscription period.
• We may discontinue the service at any time with 30 days' notice to active subscribers. In such a case, subscribers will receive a pro-rata refund for the unused portion of their subscription.

10. Third-Party Services

Alpha Factory integrates with third-party services including Discord (authentication and community), Stripe (payments), and others. Your use of these services is subject to their respective terms. We are not responsible for the availability, accuracy, or practices of third-party services. Market data displayed on the platform is sourced from third-party providers and may be delayed or inaccurate.

11. Changes to These Terms

We may modify these Terms of Service at any time. Material changes will be communicated to registered users via email at least 14 days before they take effect. Your continued use of the platform after changes become effective constitutes acceptance of the new terms. If you disagree with the changes, you may cancel your subscription and stop using the platform.

12. Governing Law and Disputes

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or related to these terms or your use of Alpha Factory shall be subject to the exclusive jurisdiction of the courts in the Netherlands. Before initiating legal proceedings, both parties agree to attempt to resolve disputes amicably through direct communication.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
