Circle Under Fire: $280M Drift Protocol Lawsuit Exposes Stablecoin Freeze Dilemma

Stablecoin issuer Circle is now defending itself in a class action lawsuit that challenges its inaction during one of crypto's biggest heists. Drift Protocol investors claim Circle had the power to stop the $280 million exploit but chose not to intervene.

The Legal Challenge

Drift investor Joshua McCollum filed the suit on behalf of over 100 affected members in US district court in Massachusetts, alleging Circle failed to freeze roughly $230 million in USDC stolen during an April 1 exploit. The complaint accuses Circle of aiding and abetting the conversion of stolen assets and negligence in its response.

Here's the core claim: attackers transferred the USDC from Solana to Ethereum using Circle's Cross-Chain Transfer Protocol (CCTP) over several hours. McCollum's legal team argues this window presented a clear opportunity for intervention. "Circle permitted this criminal use of its technology and services," the lawsuit states. "These losses would not have occurred, or would have been substantially reduced, had Circle taken timely action."

The law firm representing McCollum is pursuing damages to be determined at trial, while highlighting a critical technical capability: Circle had frozen 16 USDC wallets roughly a week before the Drift incident in connection with another sealed civil case—proof the company possessed the freeze infrastructure.

The Grey Zone in Crypto Security

This case exposes a murky legal landscape that many crypto intelligence analysts are watching closely. Companies like Circle control significant portions of the blockchain infrastructure but operate in regulatory ambiguity about when—and whether—they should exercise that control.

Crypto analytics firm Elliptic identified the attackers as likely North Korean state-backed hackers who executed over 100 transactions during US business hours. The stolen funds were converted into Ethereum (ETH) and then funneled through Tornado Cash privacy protocol to obscure their trail—classic money laundering playbook in the crypto ecosystem.

The Rule-of-Law Tension

Circle's decision not to freeze drew criticism, but ARK Invest's director of research for digital assets, Lorenzo Valente, argued the company made the right call. His reasoning cuts to the heart of what we're seeing play out across crypto trading and portfolio risk management: unilateral freezing authority without legal orders sets dangerous precedent.

"Every future freeze is now a judgment call," Valente noted. "Every non-freeze is a political statement. Why freeze the Drift hacker but not that sketchy Nigerian fraud wallet? Why this protester but not that one?"

Valente speculated the proceeds will likely fund North Korea's nuclear weapons program but maintained that freezing assets without explicit legal authority creates arbitrary discretion that erodes rule-of-law principles.

Circle hasn't publicly responded to our inquiries about the lawsuit or its response protocols.

Alpha Take

This lawsuit crystallizes a core tension in crypto market infrastructure: companies can't simultaneously claim they're neutral platforms while maintaining freeze capabilities. Circle faces a no-win scenario—act unilaterally and set precedent for corporate overreach, or follow legal process and watch attackers move funds in real-time. The outcome will reshape how stablecoin issuers approach asset security and blockchain bridge governance going forward.
