Phantom and Hyperliquid Push CFTC to Overhaul Outdated Derivatives Framework for Crypto

Phantom and Hyperliquid are making a direct pitch to the Commodity Futures Trading Commission: update your rulebook for onchain derivatives, or risk killing innovation in crypto trading.

The two companies are urging the CFTC to exempt blockchain developers and non-custodial wallet providers from regulations originally designed for traditional financial intermediaries. This isn't a minor technical request—it's a fundamental ask to reshape how crypto derivatives are regulated in America.

The Core Problem

The current CFTC framework treats decentralized protocols the same way it treats centralized exchanges like CME. That's a category error. When you're using a smart contract to trade perpetual futures, there's no custodian holding your funds, no clearing house, and no intermediary taking the other side of your trade. Yet the CFTC's existing rules assume all of that exists.

Phantom and Hyperliquid are right to call this out. The regulatory structure was built for a financial system where humans manage money. Onchain derivatives work differently—they operate through transparent, immutable code that anyone can verify. The intermediary isn't a company; it's mathematics.

Why This Matters for Crypto Markets

The crypto derivatives market has exploded. Hyperliquid alone processes billions in daily volume on its decentralized perpetuals platform. Phantom, as a leading non-custodial wallet, is the actual gateway for millions of retail traders accessing these markets. Both platforms understand the practical reality: current rules don't fit the technology.

What's particularly sharp about their approach: they're not asking for lighter regulation. They're asking for appropriate regulation. There's a difference. The CFTC should still have oversight of onchain derivatives. Fraud prevention, market manipulation detection, and systemic risk monitoring remain essential. But the guardrails need to match the actual architecture of decentralized finance.

The Timing

This regulatory push comes as the crypto market has matured significantly. We're past the days when crypto derivatives existed only on unregulated offshore exchanges. Today, major institutional players, sophisticated traders, and retail investors are all accessing these markets through legitimate protocols. The CFTC can either adapt its framework to acknowledge this reality, or continue pretending that decentralized derivatives should follow rules designed for JP Morgan's derivatives desk.

The exemption request specifically targets blockchain developers and wallet providers—the infrastructure layer. This makes sense. A wallet isn't a broker. A smart contract developer isn't a commodity pool operator. Bundling them into traditional intermediary categories creates impossible compliance burdens that don't actually protect consumers or markets.

Alpha Take

Phantom and Hyperliquid have identified a genuine regulatory arbitrage: American companies building legitimate crypto derivatives infrastructure are operating in legal gray areas while offshore competitors face no such constraints. Smart CFTC modernization here could actually strengthen US crypto market competitiveness while establishing clearer guardrails. Watch whether the commission treats this as innovation to enable or disruption to suppress—that answer will tell you everything about crypto's regulatory future in America.
